Terms and Conditions of Hire Agreement

1. Definitions

  • "The Crockery Company" refers to the business entity providing the tableware rental services.

  • "Customer" refers to the individual or entity hiring the tableware from The Crockery Company.

  • "Tableware" refers to the collection of tablecloths, charger plates, dinner plates, entree plates, napkin & table placements, cutlery, and glassware.

2. Rental Agreement

  • By renting tableware from The Crockery Company, the Customer agrees to be bound by these Terms and Conditions.

  • The Customer acknowledges that the rental period begins upon receipt of the tableware and ends upon its return to The Crockery Company.

  • The Customer is responsible of the tableware hired for the duration of the rental period and all tableware hired should not be used by any third party.

3. Rental Fees and Payment

  • The Customer agrees to pay the rental fee as specified in the invoice provided by The Crockery Company.

  • Payment must be made in full before or on the agreed-upon rental date.

  • The Customer is responsible for making sure all the information provided on the invoice by The Crockery Company is correct prior to full payment.

  • A refundable security deposit may be required and will be returned to the Customer after the tableware is returned in the same condition as when rented.

  • A 30% deposit is required to secure the hired items for the date specified by the Customer. Failure to receive payment of deposit within the 7 days after an invoice is issued, will result in The Crockery Company not holding the Customers date or items.

4. Delivery and Return

  • The Crockery Company will arrange for the delivery and pickup of the tableware at locations specified by the Customer.

  • The Crockery Company only offers delivery to maintain the quality of all their tableware.

  • The Customer is responsible for ensuring that they are present and available at the specified location to accept and return the tableware.

  • It is up to the Customer to confirm the date and time of when the products are to be delivered and picked up.

  • The tableware must be returned in the same condition as when rented. Any damages (chips or breaks), missing or stained items may result in the bond being forfeited.

  • The Crockery Company can refuse to deliver hired items if they believe it is unsafe to do so.

  • A security bond is held incase the Customer breaks the rental agreement. The security bond will be returned by The Crockery Company once the hired items have been assessed and counted. This can take up to 2 weeks from the date of the event.

5. Use and Care

  • The Customer is responsible for using the tableware with reasonable care and in accordance with its intended purpose.

  • Any damage or loss due to misuse, abuse, or negligence will be the responsibility of the Customer and may result in additional charges.

  • All products are to be returned by the Customer, unless pickup is organised, to The Crockery Company in the same condition they were delivered.

6. Liability

  • The Crockery Company is not liable or takes any responsibility for any injury, damage, death or loss incurred by the Customer or third parties as a result of the use of the tableware provided.

  • The Customer is responsible for obtaining any necessary insurance coverage for the rented tableware if desired.

7. Cancellation

  • Cancellation of a rental must be made in writing at least 90 days prior to the scheduled rental date. Cancellations made after this period may result in a forfeiture of the initial deposit.

  • If a state emergency is declared, The Crockery Company will be in contact with the Customer to reschedule the date of their event or a credit note (with no expiry date) will be issued. No refunds will be issued.

8. Compliance with Australian Consumer Law

  • These Terms and Conditions are subject to the Australian Consumer Law, and nothing in this agreement excludes, restricts, or modifies any guarantee, warranty, term, or condition that cannot be excluded, restricted, or modified by law.

9. Governing Law

  • This agreement is governed by the laws of NSW. Any disputes arising from this agreement will be resolved in accordance with the laws of that jurisdiction.

10. Entire Agreement

  • These Terms and Conditions constitute the entire agreement between The Crockery Company and the Customer and supersede all prior agreements, understandings, or representations.

  • By accepting these Terms and Conditions, the Customer acknowledges that they have read, understood, and agreed to abide by them. The Crockery Company reserves the right to update these Terms and Conditions without notice.

  • The Crockery Company will deem an initial deposit as an acceptance to the above Terms and Conditions.
